The Nigeria Bar Association (NBA) is yet to prosecute a lawyer, Okechukwu Nweaze, for misrepresenting his client, the former governor of Kano State, Rabiu Kwankwaso, in court.
Justice Muhammad Yahya of the state high court had ordered the NBA to punish the lawyer.
Pensioners in Kano State had dragged the former governor to the Economic and Financial Crimes Commission for alleged embezzlement of pensions funds while he was governor from 2011 to 2015.
But a Kano High Court ruled two months ago that the NBA should investigate and possibility prosecute the ex-governor’s lawyer, Mr. Nweaze, for allegedly misrepresenting his client in court.
Earlier, the lawyer sought order barring the EFCC from arresting Mr. Kwankwaso, a serving senator, in order for him to discharge his legislative and oversight functions.
The court further heard that the senator confined himself to his residence to avoid infringement of his right to movement by the anti-graft agency.
But Mr. Kwankwaso later claimed the lawyer misrepresented him, saying the position presented by the lawyer was not authorized by him.
The presiding judge, Mr. Yahya, therefore ordered the NBA to investigate Mr. Nweaze for misrepresenting the former governor.
But the chairman of the Kano chapter of the NBA, Mamman Yusufari, however told reporters that the association is yet to receive a formal court order asking it to commence investigations into the matter.
The chairman noted that he only heard and read the court order on the matter on the pages of newspapers and on radio.
“Obviously, you don’t expect us to act based on the story we heard in the media. We should have a formal court order sent to us before we take any decision,” he added.
He said the NBA is a serious body that attaches premium to professional integrity, noting that the association will take action as soon as they are served the order.
Mr. Yusufari explained that immediately they get the order, the body will refer it to a disciplinary committee, which would be mandated to quickly investigate the matter.
He said the NBA will prosecute the lawyer if found wanting.
